1) Although every effort is made
by Overseas Property Group its agents, associates or employees
to verify information given in their web site, brochures,
and promotional material, it must be clearly understood that
such information does not form part of any contract or offer.
Any intending purchaser or tenant of a property or a business
must satisfy themselves as to the correctness of any information
either printed or verbally issued by Overseas Property Group,
its agents, associates or employees.
2) Overseas Property Group its agents, associates or employees
make every effort to keep up to date the information stated
in it’s web site, brochures and other promotional material,
but it cannot guarantee that particular properties and businesses
will still be available for sale when prospective purchasers
travel to view. Vendors may increase or decrease the price
of properties/ businesses and no guarantee is given that the
price shown in Overseas Property Plus web site or brochure
will remain accurate.
3) Overseas Property Group its agents, associates or employees
does not accept any liability to interested purchasers or
tenants resulting from their inability to view properties
and businesses in which they may be interested due to the
fact that the properties or businesses may no longer be available
for sale, or to let, or due to revision of purchase prices,
or due to unforeseen circumstances.
4) With regard to businesses. All turnover and profit estimates
given in the brochure are 'word of mouth' from the vendors.
It remains the responsibility of the purchaser to verify the
accuracy of these figures. Overseas Property Group its agents,
associates or employees makes no guarantees with regard to
the profits which can be earned from such businesses, nor
with regard to the date on which such businesses may commence
to earn profits and it cannot be responsible for any delays
or failure of a business to produce expected profits.
5) Overseas Property Group its agents, associates or employees
operates as an introducing agent to assist interested persons
in finding and purchasing properties and businesses. Overseas
Property Group is not liable for any loss which they may incur
for any reason whatsoever resulting from their interest in
purchasing, attempted purchase or actual purchase of a property
or a business.
6) Land, property and room sizes given in Overseas Property
Plus its agents, associates or employees web site, brochure
or any promotional material are subject to survey. It remains
the responsibility of the purchasers to satisfy themselves
as to the correctness of such information.
7) All contracts for transport by rail, sea, air or on land,
for accommodation, board and lodging, for legal and estate
agency services, or for any other associated services shall
be deemed to be contracts between the person/s travelling
and the service provider. Overseas Property Group its agents,
associates or employees shall not be liable for any claims,
loss, liabilities or judgements arising out of such contracts.
8) Overseas Property Group its agents, associates or employees
makes every endeavour to recommend only reliable and reputable
providers of transport, accommodation, legal, estate agency
and other services and shall not be held responsible or liable
for any loss or damage resulting from such recommendations.
9) Overseas Property Group its agents, associates or employees
shall not be held liable or responsible for the actions of
other persons or companies or firms with which it may be associated
or have connections with.
10) Building plots - Building plots described in Overseas
Property Plus web site, brochure and promotional literature
comply with the minimum plot size requirements at the time
of going to press. These requirements are subject to change
and it remains the responsibility of purchasers of plots of
land to acquire all necessary planning consents and licences.
11) Any disputes regarding property shall be resolved according
to the laws of the country in which the property is situated.
12) Accommodation. Where this is arranged by our associates
it will always be at their discretion and this must be paid
on arrival, by either traveller’s cheques or cash. Cheques
drawn on UK banks are not acceptable.
13) Insurance. When travelling abroad it is advisable to
arrange suitable comprehensive insurance cover. Overseas Property
Group its agents, associates or employees accept no liability
whatsoever for losses, damages, compensation or personal injury
resulting from a viewing trip.
14) Building time. Whilst every effort is made by Overseas
Property Group its agents, associates or employees to give
accurate information to purchasers of “off plan”
properties as to the building time of such properties it must
be clearly understood that purchasers contracts are with the
relevant construction company and not with Overseas Property
Group its agents, associates or employees .Estimated building
times are given by the relevant construction company and it
should be clearly understood that delays may occur. Overseas
Property Group its agents, associates or employees accepts
no responsibility for any such delays.
15) It must be clearly understood that once a purchaser pays
a deposit and exchanges contracts with a construction company
then such deposits are non-refundable.
16) Refundable deposits are only accepted on condition that
prospective purchasers change their refundable deposit to
a definite and non-refundable deposit within 14 days of reservarion..
Such deposits are fully refundable during this 14 day time
period. Thereafter the relevant contract will be cancelled
and the deposit (less handling charges) will be refunded.
17) If a property has been purchased with a view to re-selling
please note that Overseas Property Group its agents, associates
or employees do not guarantee selling properties prior to
completion have no control over the volume of purchasers or
their requirements. Every effort will be made to market your
property through our associates in the relevant country, however,
no guarantee is given either to possible profits or the time
taken to re-sell the property. Overseas Property Group its
agents, associates or employees does not require exclusivity
to market re-sale properties. Purchasers are free to market
their properties themselves or through Estate Agencies of
their choice.
18) Investment Properties. Where properties are purchased
with a view to re-selling at a later date at a profit Overseas
Property Group its agents, associates or employees offer no
guarantee either to such possible profit or to the period
of time it will take to realise such possible profit. Whilst
every assistance will be given to a vendor to sell such investment
properties through our associate partners Overseas Property
Group its agents, associates or employees offer no guarantee
as to
re-sale values.
19) With any property that is purchased through Overseas Property
Group its agents, associates or employees, to sell on at the
clients own decision, it must be pointed out that there will
be charges by all Overseas Property Companies in re-selling
the clients property. These charges can vary considerably
and may range from 5% of the property price excluding vat
if applicable to a fixed fee. Overseas Property Group its
agents, associates or employees accept no liability for any
agreements by these companies as we only help you to market
these properties through our agents and associates throughout
the World.
20) Properties that have been purchased for re-sale before
completion can only be re-sold when a building licence has
been issued to the relevant construction company. If such
properties are re-sold before the issue of building licence
then all monies will be held by a Spanish lawyer appointed
by Overseas Property Group its agents, associates or employees
until such time as the building licence is issued to the relevant
construction company (other than by prior written agreement
by Overseas Property Group its agents, associates or employees
).
21) Income Tax due on profits made on re-sale is entirely
the responsibility of the vendor.
22) Overseas Property Group its agents, associates or employees
operates only as an introducing agency to assist interested
persons in finding and purchasing properties and businesses
from a range of developers, agents and associates. All future
customer queries with the property purchased are dealt with
by the developer or agent who issues your contract. All legal
queries should be directed to the lawyer you have appointed
and not Overseas Property Group . its agents, associates or
employees.
